Short answer: yes. Kratom is legal to buy and sell in Georgia for adults 21 and older, under the state's Kratom Consumer Protection Act (KCPA), passed in 2019.

The details that actually matter

  • Age requirement — you must be 21+ to purchase kratom in Georgia. Elevated 369 checks ID on every kratom purchase, no exceptions.
  • 7-OH cap — Georgia House Bill 181 (HB181), effective January 1, 2025, caps 7-hydroxymitragynine (7-OH) at 2% of a kratom product's total alkaloid content and sets labeling and behind-the-counter display requirements that retailers must follow.
  • What's not allowed — products that don't meet the KCPA's purity, labeling, and 7-OH concentration standards aren't legal to sell in Georgia, regardless of what's legal in other states.
  • What's currently uncertain — Georgia lawmakers have introduced bills (including HB968) that would move mitragynine and 7-OH to Schedule I under state law, which would make them illegal, not just regulated. As of this writing, that has not passed.
  • Federal law — kratom is not currently a federally scheduled controlled substance, though the FDA recommended DEA scheduling for concentrated 7-OH products specifically (not natural leaf kratom) in July 2025. That recommendation has not been finalized by the DEA as of this writing.
