Are Amanita Mushroom Products Legal in Georgia?

Short answer: yes. Amanita muscaria — the mushroom behind the Polka Dot, Silly Farms, Tre House, Roadtrip, and Shroomy Pop products we carry — is not a federally scheduled controlled substance, and Georgia does not restrict it at the state level the way some other states have started to.

Important distinction

Amanita muscaria is a completely different species from psilocybin ("magic") mushrooms. Psilocybin is a Schedule I controlled substance federally and illegal in Georgia. Amanita muscaria works through different compounds (muscimol and ibotenic acid) and sits in a different legal category entirely. We only carry Amanita-based products — nothing psilocybin-related, ever.

One thing worth knowing

In December 2024, the FDA issued a warning that amanita-derived compounds (muscimol and ibotenic acid) are considered unauthorized food additives under federal food law. This is a different kind of regulatory concern than a controlled-substance ban — it's about how products are marketed and sold as food/supplement items, not a statement that the mushroom itself is illegal to possess or sell. We mention it because we'd rather you know the full picture than have us leave something out.

Age requirement

Georgia doesn't mandate a minimum age for Amanita products the way it does for kratom, but Elevated 369 sells these to adults 21+ only, as a store policy, consistent with everything else we carry.
